Terms of Service
Terms of service, physical measurement disclaimer, pricing, and consumer rights for Tileria
1. Scope of Service
Tileria provides an interactive digital planning tool and tile calculation software specifically tailored for DIY homeowners and renovators. The platform assists users in planning room dimensions, evaluating tile patterns, and generating visual layout previews.
Our basic calculation tools, 2D visual layouts, and tile count estimates are accessible free of charge without registration. The optional purchase of a premium blueprint unlocks full millimeter-accurate perimeter cut dimensions, custom waste buffer calculations, and an exportable PDF cutting schedule.
2. Physical Measurement Verification Disclaimer
Users are responsible for verifying actual physical room dimensions and wall squareness on-site before cutting tiles, purchasing materials, or commencing physical installation.
Limitation of Liability
Tileria is liable without limitation for intent, gross negligence, and damages arising from injury to life, body, or health. In the event of a slightly negligent breach of an essential contractual duty (cardinal duty – a duty whose fulfillment is essential to the proper performance of the contract and on whose compliance the customer regularly relies), liability is limited to typical, foreseeable damages at the time of contract formation. Any further liability is excluded.
3. Pricing & Contract Formation
Access to the comprehensive cut list and printable PDF blueprint is available for a one-time payment of €9.99 (including applicable statutory VAT). There are no recurring subscription fees, hidden renewals, or ongoing charges.
A binding contract for digital blueprint access is concluded when you complete the checkout process provided by our Merchant of Record and payment is successfully authorized.
4. Merchant of Record (Billing & Payments)
Our order process and payment transactions are handled by our Merchant of Record, Lemon Squeezy, LLC (222 S. Main Street, Suite 500, Salt Lake City, UT 84101, USA).
Lemon Squeezy acts as the contractual seller and Merchant of Record for all purchases. Lemon Squeezy handles order placement, payment processing, invoicing, and the collection and remittance of statutory sales tax and EU Value Added Tax (VAT).
5. Immediate Digital Delivery & Statutory Waiver of 14-Day Right of Withdrawal (§ 356 Abs. 5 BGB)
As an EU consumer, you generally possess a statutory 14-day right of withdrawal for distance contracts.
Premature Expiry of the Right of Withdrawal for Digital Content
Pursuant to § 356 Abs. 5 BGB (German Civil Code) and Article 16(m) of the EU Consumer Rights Directive, your right of withdrawal expires prematurely for contracts concerning the supply of digital content not supplied on a tangible medium if performance has begun with your prior express consent and your acknowledgment that you thereby lose your right of withdrawal once performance has begun.
By purchasing blueprint access and initiating immediate digital delivery, you agree that instant digital access begins immediately and acknowledge that your right of withdrawal ends upon delivery.
6. Lifetime Access & Post-Purchase Adjustments
Immediately upon payment confirmation, an automated transactional email containing a permanent access link is dispatched to your provided email address. This link grants perpetual access to your project blueprint on any modern browser without requiring a user password.
You can fine-tune tile alignment offsets, shift starting points, and adjust waste percentages at any time after purchasing. All modifications auto-save in real time to your cloud project state.
7. Applicable Law & Dispute Resolution
These terms and all contractual relationships between Tileria and the user are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers habitually resident in an EU member state, mandatory statutory consumer protection provisions of that state remain unaffected.
The European Commission provides an online dispute resolution (ODR) platform:
We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board according to § 36 VSBG.
8. Statutory Warranty for Digital Products
Statutory warranty rights pursuant to §§ 327 ff. BGB apply to the digital planning tools and downloadable blueprints.
If the digital product is defective or fails to conform with agreed specifications, you have statutory rights to cure, price reduction, or contract termination in accordance with German statutory law.
